ERE 2026: Valoración de las condiciones de salida / ERE 2026: Assessment of exit conditions
Como es conocido, este pasado jueves, finalizó de madrugada el proceso formal de negociación del ERE 2026 entre la RLT y People. Tal como informamos, los 8 representantes de STC (de un total de 13 en la mesa) firmamos el documento con las condiciones de salida, quedando supeditado a la ratificación en referéndum por parte de la plantilla.
Mañana recibiréis un correo con un enlace para votar en referéndum. Estará abierto hasta el miércoles día 25 a las 16:00. Se realiza con la herramienta externa proporcionada por Ericsson, Netigate, que garantiza identificación segura, solo admite un voto por persona, el voto es secreto, y registra el proceso completo para que pueda ser auditado.
Con el fin de facilitar la máxima información sobre las condiciones, y que la votación sea consciente y libre, exponemos de manera honesta los términos alcanzados:
- El periodo de voluntariedad y análisis para posibles rotaciones se ha extendido hasta un total de 8 semanas. Esto es muy positivo en cuanto a la gestión de la voluntariedad.
- Las condiciones de salida incluyen un plan social para un colectivo que abarca a 875 personas, nacidas en el año 1973 o anteriores.
- Las condiciones alcanzadas llevan hasta los 63 las cotizaciones a la seguridad social a todo el colectivo, también a los planes de rentas. Las prejubilaciones cotizarán por la misma base que tenga la persona afectada, mientras que los planes de renta cotizarán por un salario de 2.900€ mensuales.
- La empresa seguirá pagando las cotizaciones a la seguridad social a las personas que a los 63 años no alcancen la cotización suficiente para jubilarse anticipadamente hasta que alcancen 33 años de cotizaciones o 65 años, lo que ocurra antes
- Las condiciones económicas de las salidas en cuanto a mínimos y máximos de prejubilaciones y lineales en indemnizaciones están basadas en las del ERE del 2017, aplicando la actualización del IPC.
- La introducción de la elegibilidad en prejubilaciones en el último tramo de la negociación hace que los mayores de 61 años cobren como mínimo el equivalente a la renta máxima de la prejubilación (3.250€) hasta los 65 años para el salario medio.
- Las personas que cumplan los requisitos de prejubilación no podrán elegir una indemnización (45 dias + 33 dias) con tope de 24 mensualidades. Mientras que las personas con su misma edad que no tengan 17 años de antigüedad si podrán.
- No se asegura un 100% de voluntariedad
- Los colectivos protegidos quedan protegidos hasta un cierto porcentaje.
- Las personas mayores de 50 años no podrán solicitar subsidios por desempleo (sí que tendrán la prestacion contributiva por desempleo), como el de mayores de 52 años. Si lo hicieran, deberían devolver a la empresa las cantidades abonadas en su nombre al Tesoro Público.
- Las personas de 50, 51 y 52 años solo podrán acogerse al cese indemnizado y no podrán solicitar subsidios ni acceder a medidas adicionales de acompañamiento (sí que tendrán la prestación contributiva por desempleo).

- Informe contradictorio elaborado por STC rebatiendo las causas argumentadas por la empresa. Hemos excluido la justificación de los puestos concretos para no revelar detalles que puedan afectar a personas concretas.
STC firmó el preacuerdo con el objetivo de posibilitar la convocatoria de un referéndum a la plantilla, de modo que sea ésta quien determine su posición respecto al acuerdo y, en consecuencia, su futuro en relación con el proceso. En caso de no haberse suscrito, la única alternativa era la de judicializar directamente el proceso. Asimismo, en función del resultado adoptaremos las actuaciones que correspondan.
Esperamos que el número de personas que soliciten adscribirse a alguna de las opciones de salida sea superior a los puestos a extinguir
En este contexto, cubrir el número previsto de salidas sin necesidad de aplicar medidas de carácter forzoso depende únicamente de la voluntad de la compañía.
En caso de producirse despidos no voluntarios, STC pondrá a disposición de las personas afectadas su servicio jurídico para analizar, si así se solicita, las posibles actuaciones. STC hemos hecho una apuesta por el diálogo y la paz social, esperamos que la empresa esté a la altura.
As is well known, this past Thursday, the formal negotiation process for the 2026 redundancy plan between the RLT and People ended in the early hours of the morning. As we reported, the eight STC representatives (out of a total of 13 at the table) signed the document with the exit conditions, subject to ratification by the workforce in a referendum.
Tomorrow you will receive an email with a link to vote in the referendum. It will be open until Wednesday, the 25th, at 4:00 p.m. It is carried out using the external tool provided by Ericsson, Netigate, which guarantees secure identification. Only those on the census can vote, and only once. Voting is secret, and the entire process is recorded so that it can be audited.
In order to provide as much information as possible about the conditions and to ensure that the vote is informed and free, we are honestly presenting the terms agreed upon:
• The period of voluntary participation and analysis for possible rotations has been extended to a total of 8 weeks. This is very positive in terms of managing the voluntary process.
• The exit conditions include a social plan for a group of 875 people born in 1973 or earlier.
• The conditions agreed upon extend social security contributions to the entire group until the age of 63, as well as income plans. Early retirees will contribute on the same basis as the person concerned, while income plans will contribute on the basis of a monthly salary of €2,900.
• The company will continue to pay social security contributions for people who, at the age of 63, do not have sufficient contributions to take early retirement until they reach 33 years of contributions or 65 years of age, whichever comes first.
• The financial conditions of the departures are based on those of the 2017 redundancy plan, applying the CPI update.
• The introduction of eligibility for early retirement in the final stage of the negotiations means that those over 61 years of age will receive at least the equivalent of the maximum early retirement income (€3,250) until the age of 65 for the average salary.
• People who meet the early retirement requirements will not be able to choose compensation (45 days + 33 days) with the limits of 24 monthly payments. However, people of the same age who do not have 17 years of service will be able to do so.
• 100% voluntariness is not guaranteed.
• Protected groups remain protected up to a certain percentage.
• People over the age of 50 will not be able to apply for unemployment benefits, such as those for people over the age of 52. If they do so, they must repay the company the amounts paid on their behalf to the Treasury.
• People aged 50, 51, and 52 will only be eligible for severance pay and will not be able to apply for benefits or access additional support measures.

• Contradictory report prepared by STC refuting the reasons given by the company. We have excluded the justification for specific positions so as not to reveal details that could affect specific individuals.
STC signed the preliminary agreement with the aim of enabling a referendum to be held among the workforce, so that they could determine their position on the agreement and, consequently, their future in relation to the process. If it had not been signed, the only alternative was to take the process directly to court. Likewise, depending on the outcome, we will take the appropriate action.
A large number of people have shown interest in signing up for one of the three exit systems set out in the exit conditions document, exceeding the number of redundancies announced by the company.
In this context, covering the expected number of departures without the need to apply compulsory measures depends solely on the company’s willingness.
In the event of involuntary dismissals, STC will make its legal service available to those affected to analyze, if requested, possible actions. Likewise, this situation could have an impact on the working environment and existing relationships.
