ERE 2026 – Segunda reunión de la Negociación / ERE 2026 – Third negotiation meeting


La reunión del día de ayer ha versado principalmente sobre la justificación por parte de la empresa de los puestos a amortizar. 

  • No se acredita una amortización real y efectiva del puesto, conforme a la doctrina jurisprudencial.
  • No concurren causas organizativas o productivas en los términos exigidos por el artículo 51 ET.
  • El despido colectivo propuesto no supera el juicio de necesidad, razonabilidad y proporcionalidad.
  • La medida responde a una reorganización interna y a una estrategia de reducción de costes, insuficiente jurídicamente para justificar la extinción de contratos.

No hemos recibido evidencia de que la empresa haya agotado todas las medidas razonablemente exigibles antes de proceder a la extinción de puestos de trabajo, y tampoco el análisis a corto/medio plazo de los beneficios que se van a obtener al aplicar esta reducción en la plantilla.

Consideramos que no quedan debidamente justificadas las causas alegadas por la empresa, ni consta que se hayan realizado los esfuerzos necesarios para mitigar este impacto.

Así mismo, entendemos que el número de 180 despidos se puede ver reducido considerablemente, máxime cuando hay abiertas vacantes y la dinámica de la dinámica de contratación de la compañía continúa activa. Sin ir más lejos en 2025 se incorporaron 83 personas nuevas a la compañía, además de otras 3 en este mismo mes de enero. ¿Cuántas más serán contratadas a lo largo de 2026? Muchas de estas incorporaciones son de los mismos roles que quieren reducir.

Yesterday’s meeting focused mainly on the company’s justification for the positions to be eliminated.

•    There is no evidence of actual and effective elimination of the position, in accordance with case law.

•    There are no organizational or production reasons as required by Article 51 of the Workers’ Statute.

•    The proposed collective dismissal does not meet the criteria of necessity, reasonableness, and proportionality.

•    The measure is in response to an internal reorganization and a cost-cutting strategy, which is legally insufficient to justify the termination of contracts.

We have not received evidence that the company has exhausted all reasonably required measures before proceeding with the termination of jobs, nor have we received a short/medium-term analysis of the benefits to be obtained from implementing this reduction in the workforce.

We consider that the reasons given by the company are not duly justified, nor is there any evidence that the necessary efforts have been made to mitigate this impact.

Likewise, we understand that the number of 180 redundancies could be considerably reduced, especially when there are vacancies and the company’s recruitment process remains active. Without going any further, in 2025, 83 new people joined the company, in addition to another 3 this January. How many more will be hired throughout 2026? Many of these new hires are in the same roles that they want to reduce.
