Detalles sobre nuevo auto de registro retributivo / Details About New Order on Remuneration Registration

Desde STC queremos informaros que hay un nuevo auto sobre la ejecución provisional de la sentencia de registro retributivo. La sentencia ya obligaba a la empresa a entregar a la RLPT la media y mediana de los salarios de todas las categorías sin excepción, tal y como el servicio jurídico de STC ha defendido desde el principio.

Aclarar que en STC no tenemos ningún interés en conocer los salarios de ninguna persona, la ley obliga a que se conozca la media y mediana de toda la plantilla de modo que se puedan identificar posibles desviaciones y diferencias salariales. Lo que sucede es que la empresa ha hecho una clasificación tan extensa de estas categorías que algunas personas trabajadoras pudieran identificarse al estar en grupos muy reducidos. STC intentó un acuerdo en el SIMA, para reclasificar en grupos más extensos a todas estas personas, en su mayoría MANAGERS y ALTA DIRECCIÓN, y así evitar que la media/mediana pudiera exponer su salario. La negativa de Ericsson al acuerdo ha provocado que sean los Tribunales quienes intercedan.

En este auto anulan la iniciativa de la empresa de solicitar consentimiento a la plantilla para compartir sus datos retributivos con la RLPT, y en consecuencia, la empresa debe facilitar la media y la mediana salarial de toda la plantilla. El propio Tribunal, dada la insistencia de la empresa a no acatar la sentencia, la ha sancionado “… la cuantía del apremio pecuniario a imponer a la empresa a 150 euros diarios desde la firmeza de la presente resolución, ex art. 241.1 LRJS”. Os recordamos que desde STC llevamos más de dos años trabajando junto con CGT en este asunto, intentando que la empresa cumpla con la ley, y poder realizar una vigilancia fehaciente que evite discriminaciones salariales.

Lamentablemente uno de los sindicatos afines a la empresa no solo se opuso a la demanda sino que además aceptó que la empresa excluyera los datos salariales de aproximadamente 400 personas: “Estimamos íntegramente las demandas interpuestas por las representaciones letradas de la CONFEDERACIÓN GENERAL DEL TRABAJO (CGT) y del SINDICATO DE TRABAJADORES DE COMUNICACIONES (STC) frente a ERICSSON ESPAÑA S.A, a las que se opuso la FEDERACIÓN DE INDUSTRIA DE COMISIONES OBRERAS (FI-CC.OO)”.

Para rematar este despropósito, en las pruebas presentadas para defender el AUTO, la empresa aportó un email de un representante de los trabajadores de Torre Suecia de uno de sus sindicatos afines, donde solicitaba que no se entregara su información de media y mediana a la RLPT, hecho bastante insólito que se está tratando en los CE de Ericsson. Gracias al trabajo y al esfuerzo del servicio jurídico de STC y CGT, con esta sentencia, la empresa debe facilitarnos la media y la mediana de todas las personas trabajadoras.

En este caso, como en otros donde han existido discrepancias con la empresa en STC estamos dispuestos a llegar a un acuerdo que satisfaga a todas las partes: plantilla y empresa, pero se debe posibilitar un proceso de negociación, tal y como reclamamos insistentemente, en especial para las salidas forzosas que se están produciendo y, otro tema que se debería negociar es la mejora del sistema de retribuciones. El Convenio Metal no es apropiado y el proceso de subida de mérito poco claro e insuficiente.

No se puede exigir por nuestra parte que sólo aceptemos pérdidas de derechos a cambio de nada. “NEGOCIAR ES EL ARTE DE CEDER POR AMBAS PARTES”. Que esto sea una realidad depende de la compañía, les animamos a ese cambio.


From STC we want to inform you that there is a new order on the provisional execution of the sentence on the remuneration register. The sentence already obliged the company to deliver to the RLPT the average and median of the salaries of all categories without exception, as the legal service of STC has defended from the beginning.

To clarify that in STC we have no interest in knowing the salaries of any person, the law requires that the average and median of the entire workforce is known so that possible deviations and wage differences can be identified. What happens is that the company has made such an extensive classification of these categories that some workers could be identified as they are in very small groups. STC tried to reach an agreement at the SIMA, to reclassify in larger groups all these people, mostly MANAGERS and SENIOR MANAGEMENT, to avoid that the average/medium could expose their salary. Ericsson’s refusal of the agreement has caused the courts to intervene.

In this order, they annulled the company’s initiative to request the consent of the workforce to share their salary data with the RLPT, and consequently, the company must provide the average and median salary of the entire workforce. The Court itself, given the company’s insistence on not complying with the sentence, has sanctioned it “… the amount of the pecuniary penalty to be imposed on the company to 150 euros per day from the finality of this resolution, ex art. 241.1 LRJS”. We remind you that from STC we have been working for more than two years together with CGT in this matter, trying to make the company comply with the law, and to be able to carry out a reliable monitoring to avoid wage discrimination.

Unfortunately, one of the unions related to the company not only opposed the lawsuit but also accepted that the company excluded the salary data of approximately 400 people: “We fully uphold the lawsuits filed by the legal representatives of the CONFEDERACIÓN GENERAL DEL TRABAJO (CGT) and the SINDICATO DE TRABAJADORES DE COMUNICACIONES (STC) against ERICSSON ESPAÑA S. A, which were opposed by the FEDERACIÓN DE INDUSTRIA DE COMISIONES OBRERAS (FI-CC.OO)”.

To top off this nonsense, in the evidence presented to defend the AUTO, the company provided an email from a representative of the workers of Torre Suecia from one of its related unions, where he requested that his mean and median information not be delivered to the RLPT, a rather unusual fact that is being dealt with in Ericsson’s ECs. Thanks to the work and effort of the legal service of STC and CGT, with this ruling, the company must provide us with the mean and median of all workers.

In this case, as in others where there have been discrepancies with the company in STC we are willing to reach an agreement that satisfies all parties: staff and company, but it should enable a negotiation process, as we insistently demand, especially for the forced departures that are occurring and another issue that should be negotiated is the improvement of the remuneration system. The Metal Agreement is not appropriate and the merit increase process is unclear and insufficient.

It cannot be demanded on our part that we only accept loss of rights in exchange for nothing. “NEGOTIATING IS THE ART OF GIVING IN ON BOTH SIDES”. Whether this becomes a reality is up to the company, we encourage them to that change.
