Queremos compartir los últimos avances en la mesa de seguimiento del ERE así como información que puede ser útil.
En reuniones pasadas, desde STC, hemos solicitado a la Compañía que las salidas voluntarias se produzcan a partir del 1 de abril, de manera que se haya cobrado el bono de este año en el momento del cese.
Esto es beneficioso, tanto para el cálculo de la indemnización como para la actualización de la base de cotización de aquellas personas que no llegan al máximo, puesto que con el bono se les incrementa la de los últimos meses, que es la base de cálculo para los dos años de paro.
¿Qué tengo que hacer si la empresa me convoca para comunicarme mi inclusión en el ERE y oficializar la salida? ¿Qué documentación me deben entregar?
Puedes pedir que un representante esté presente contigo durante el proceso, estamos a vuestra disposición.
Te deben entregar:
- Carta de despido donde queden reflejadas las razones de tu afectación, se haga referencia al ERE y se indique la fecha de despido.
- Información detallada de tus condiciones económicas particulares de salida.
- Liquidación de haberes, salarios pendientes, vacaciones, guardias, trabajos programados, etc.
- Documento con información relativa a la aseguradora certificando el depósito de las cantidades acordadas (aplicable solo en planes de renta y prejubilaciones)
- Documentación e información para el paro SEPE
Esta documentación debe estar firmada, puedes firmar como “recibí pendiente de revisión” si tienes dudas, guarda tu copia y escanea todos los documentos para el futuro.
Antes de acudir a esa reunión te aconsejamos que compruebes información relevante, como tus bases de cotización a la seguridad social, los días de vacaciones pendientes, importes percibidos en los últimos 12 meses para el cálculo de la indemnización; así podrás verificar que todo está correcto.
We would like to share the latest developments from the ERE monitoring committee, as well as some information that may be useful.
In past meetings, STC has requested that the Company schedule voluntary departures to begin on or after April 1, so that employees have received this year’s bonus by the time they leave.
This is beneficial both for calculating severance pay and for updating the contribution base for those who do not reach the maximum, since the bonus increases their contribution base for the last few months, which serves as the basis for calculating unemployment benefits for the next two years.
What should I do if the company calls me in to inform me of my inclusion in the layoff plan and to formalize my departure? What documentation should they provide me with?
You can request that a representative be present with you during the process; we are at your disposal.
They must provide you with:
- A termination letter stating the reasons for your dismissal, referencing the ERE, and indicating the termination date.
- Detailed information regarding your specific financial terms of departure.
- Settlement of outstanding wages, salaries, vacation time, on-call shifts, scheduled work, etc.
- Document from the insurance provider certifying the deposit of the agreed-upon amounts (applicable only to pension plans and early retirement schemes)
- Documentation and information for SEPE unemployment benefits
This documentation must be signed; you can sign as “received, pending review” if you have doubts. Keep your copy and scan all documents for future reference.
Before attending this meeting, we recommend that you verify relevant information, such as your Social Security contribution bases, outstanding vacation days, and amounts received in the last 12 months for the calculation of severance pay; this way, you can ensure that everything is correct.
